As a business wishing to participate in the Octoplus Business Promotion (the “Promotion”) (“you”), you must agree to be bound by the following Terms and Conditions (the “T&Cs”).
Introduction
The Promotion will be part of an Octoplus campaign from the 25th of November to the 15th of December. During this period, Octopus Energy will select a number of businesses and promote them on the Octoplus website.
The Promotion is organised by Octopus Energy (“we,” “us,” “our”). These T&Cs, along with any communications or instructions from us relating to the Promotion, form the basis of your application for, and participation in, the Promotion.
These T&Cs are independent of any terms governing your energy supply relationship with Octopus Energy Limited or Octopus Energy Operations Limited (collectively, “Octopus Energy Supply”). Participation in the Promotion does not alter or affect your rights and obligations under any existing energy supply agreement.
Participation
There is no entry fee to apply to join the Promotion.
Eligibility and Selection Criteria: To apply to participate in the Promotion:
- A representative of your business authorised to enter contractual arrangements on your behalf must:
- complete the required sign-up form, submit necessary business information [requested by us as part of the sign-up journey], and accept these T&Cs; and
- be aged 18 or over;
- be an executive decision-maker of a business headquartered in Great Britain (excluding Northern Ireland) with the power to enter into contracts on behalf of your business;
- You must be a domestic or business Octopus Energy customer opted-in to Octoplus;
- You must be an Octopus customer, have a functional electricity smart meter, and have consented to half-hourly data collection; and
- You must maintain an active monthly direct debit (unless using a smart prepayment meter) with us for the supply of energy; and
- you must comply fully with these T&Cs at all times during the course of the Promotion.
Octopus Energy reserves the exclusive right to determine, modify, and apply selection criteria for inclusion in the Promotion, and we may change these criteria at any time at our discretion. Submission of an application to participate in the Promotion does not guarantee that your business will be selected or included in any listings, advertisements, or promotional materials associated with the Promotion. Octopus Energy’s selection decisions are final and non-reviewable. In the event of any dispute regarding any aspect of the Promotion, Octopus Energy’s decision will be final, binding, and not subject to review or appeal.
Applications close on the 15th of November 2024 and contact you by the 20th of November to let you know if you’ve been selected. The Promotion will go live on the 25th of November 2024.
Promotion activities
Any eligible Octopus customer can apply by completing the sign-up form and accepting these T&Cs. After applying, Octopus Energy, in its sole discretion, will select a number of businesses based on the type of product and/or service offered, sustainability credentials and brand alignment (the Selection Criteria), to be featured and promoted on its website. We will contact all applicants to inform them of whether or not they have been selected.
Applying does not guarantee your business will be included in the promotion and we reserve the right to select or reject any application made at our sole discretion.
If your business is selected for the Promotion, Octopus Energy will feature your business on the Octoplus website for a certain part of the Promotion period.
In order to best promote your business, you agree to provide your business’ logo and use of your logo for the duration of the promotional period. You warrant that our use of the logo shall not infringe on any third party’s rights (including intellectual property rights) and you shall reimburse us for any losses arising in relation to claims brought against us by a third party in relation to the use of your logo.
Note that we shall not be responsible for, nor provide any support (financial or otherwise) with, any sales or business operations of your business as part of the Promotion. The benefit of the Promotion is strictly limited to us featuring you on our website and Octoplus App in such a way as we see fit.
Removal from the Promotion
Octopus Energy reserves the right to remove you from the Promotion at any time, including if at any point you cease to meet the eligibility requirements or breach any of the T&Cs. In particular, we may remove you from the Promotion under any of the following circumstances:
- If you withdrawal of consent for half-hourly meter readings;
- If there is a disconnection of your smart meter for more than 30 consecutive days;
- if your direct debit payment method is cancelled;
- if your business electricity account with Octopus Energy Supply is cancelled;
- If we find evidence of you undertaking unethical business practices;
- If we reasonably believe that you have breached these T&Cs;
- if any data or information you provide us with in relation to the promotion is incorrect, false, fraudulent or misleading; or
- if we determine that your participation in the Promotion would have an adverse effect on our reputation, brand, goodwill or financial position were you to continue participating in the Promotion;
- your brand, company or product is found not to align with the Selection Criteria; or
- If any logo, branding you provide us with infringes or we determine could reasonably infringe on a third party’s rights (including intellectual property rights).
Upon removal from the Promotion, if your business is listed on the Octopus website, it will be removed from this listing and you shall no longer be able to benefit from the Promotion. Octopus Energy shall not be liable for any losses resulting from disqualification.
Data Protection and Information Accuracy
Octopus Energy’s privacy policy governs the handling of any personal or business data collected in connection with the Promotion. This policy is available at octopus.energy/privacy.
By applying to the Promotion, you represent and warrant that all information submitted is true, current, and complete.
General Terms
- Octopus Energy reserves the right to amend, suspend, or terminate the Promotion or these T&Cs at its sole discretion without prior notice. Notice of any changes will be provided to you, and the latest version of the T&Cs will be available on our website.
- You may opt-out of the Promotion at any time by emailing hello@octopus.energy. Upon receipt, we will remove you from the Promotion promptly.
- Octopus Energy may transfer, assign, subcontract, or novate any or all of its rights and obligations under these T&Cs without obtaining your prior consent.
- Nothing in these T&Cs shall exclude or limit our liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be lawfully limited.
- To the fullest extent permitted by law, Octopus Energy shall not be responsible for any costs, expenses, or losses incurred as a result of participating in the Promotion. We are not liable for any losses arising from events beyond our control, or for any indirect, consequential, economic, or financial losses. If Octopus Energy is found liable for any direct losses you incur, our liability will be capped at £1000 per calendar year.
- These T&Cs are governed by the laws of England and Wales, and any disputes arising in connection with these terms or the Promotion will be subject to the exclusive jurisdiction of the courts of England and Wales.
