Current Account Terms and Conditions

These Terms and Conditions apply to eligible UK-based businesses referring domestic (residential) and business (commercial) energy supply customers to Octopus Energy under the "Current Account Programme" (the “Programme”).

General

  1. These Terms and Conditions apply to the "Current Account Programme’’ (the “Programme”). By joining the Programme, you agree to be bound by the following Terms and Conditions:


  2. The Programme is offered by Octopus Energy Limited, a company registered in England and Wales with registered number 09263424 and registered office UK House, 5th Floor, 164-182 Oxford Street, London, United Kingdom, W1D 1NN (“Octopus Energy”).


  3. Further details of the Programme are found on our website at https://octopus.energy/current-account/.


  4. Octopus Energy reserves the right to cancel or amend the Programme without prior notice. Any changes will be posted on our website, but we will do our best to avoid doing so. In the event of any dispute regarding any aspect of the Programme, the decision of Octopus Energy shall be final, and no correspondence will be entered into.


  5. These Programme Terms and Conditions are separate to the terms and conditions for the supply of gas and electricity that you or other customers referred to Octopus will have with Octopus Energy and nothing under these Terms and Conditions will affect your, or their, rights and obligations under those terms.


  6. The Programme pays commission (the “Commission”) to eligible UK-based businesses (the "Affiliates") who sign up via the Typeform registration, and who use this link to refer new domestic or business energy supply customers (“Referred Customers”) – subject to the eligibility criteria below – to Octopus Energy.


  7. The Programme provides a reward (the “Reward”) to Referred Customers in the form of energy credit applied to an Octopus Energy account subject to the eligibility criteria below. We will add the Reward once the Referred Customer has made their first direct debit payment to us and are supplied Energy by us.


  8. Once a month, Octopus shall provide the Affiliate with a report setting out the number of successful Referred Customers for the previous calendar month and the Commission amount due (the “Commission Report”). The Affiliate will issue a valid invoice to Octopus for the Commission due in that calendar month. Octopus shall pay the invoiced amount within 30 calendar days. All amounts payable under the Programme are exclusive of VAT, which may be added to the relevant invoice (if applicable).


  9. Domestic Customer Referrals: For each eligible domestic (residential) customer referred, the Affiliate receives a Commission of £50, and the Referred Customer receives a Reward of £50 energy credit applied to their account.


  1. Business Customer Referrals: For each eligible business (commercial) customer referred, the Affiliate receives a Commission of £75, and the Referred Business Customer receives a Reward of £75 energy credit applied to their account.


  2. Affiliates can refer persons or businesses through the personalised affiliate link that we send them (“Affiliate Link”).


  3. The Affiliate must not enter any Referred Customer data through the Affiliate Link directly. Referred Customers must enter their own data online.


  4. As long as the Affiliate is eligible for commission, Octopus grants you a non-exclusive, revocable, personal, royalty-free licence to use the Octopus trademarks and logos solely to the extent necessary for you to refer customers under these Terms and Conditions.

  5. If no referrals are made using your Link within 6 months, Octopus will deactivate the link and remove your organisation from the Programme. You can always register again if you still want to be part of it.


  6. Octopus Energy reserves the right to deactivate your Affiliate Link at any point, and to cancel or withhold any pending Commission or Rewards, if we believe in our sole discretion that there is fraudulent, suspicious, or inappropriate activity, or if these Terms and Conditions have been breached.

  7. Existing customers of Octopus Energy who have not previously received a reward credit may be eligible to receive the £50 or £75 account credit, but no Commission will be paid to the Affiliate for existing customers.


  8. Octopus may withdraw Current Account offers at any time.


    Eligibility Criteria

  9. Current Account is not intended for use on Price Comparison Websites, or by Marketing Agencies. If your business falls under either of these descriptions, we will not issue an affiliate link.


  10. You will not be eligible for the Commission if:

    18.1 You are not an authorised representative signing up on behalf of a business registered with the UK Government's website, Companies House or HMRC;

    18.2 The person or business you refer is an existing customer of Octopus Energy (including any of its whitelabel brands), or is supplied under the Bulb energy supply licence;

    18.3 The person or business you refer cancels their agreement with us before their Supply Start Date or their first successful direct debit payment;

    18.4 The person or business you refer has been a customer of Octopus Energy within the last 12 months;

    18.5 You do not refer a customer to us through your Affiliate Link. Referrals not made through your Affiliate Link, for example if the person or business you refer signs up through a third party such as a price comparison site, or which are claimed retrospectively are not eligible and will not be rewarded; and

    18.6 We have reason to believe you are paying for ads to promote your Affiliate Link. It's great that you love us so much that you're willing to pay to spread the word, but if you pay for ads, you're really not sharing with your network, and our advertising costs increase. If we find that you are sharing your link through paid advertising, we reserve the right to deactivate your Affiliate Link.

  11. If the person or business you refer qualifies for more than one type of marketing incentive, we reserve the right to give the customer just one incentive which will be the highest value incentive of those for which they qualify.

  12. For the avoidance of doubt existing customers who have already claimed and received a switching offer, including refer a friend of another affiliate offer, will not be eligible to receive the Reward. Octopus shall in its sole discretion have the right to not pay a Reward if the Referred Customer breaches these Terms and Conditions.

  13. Individuals not associated with a business who wish to refer other people to Octopus must use their refer-a-friend link, unless they qualify as and have signed up to be a high referrer.


    Data Protection and Publicity

  14. By participating in the Programme, you agree to the reasonable use of your name and image on the Octopus Energy website and in the media and materials produced by or on behalf of Octopus Energy in relation to the Programme. Octopus Energy will retain the rights to any media and materials produced.

  15. Octopus Energy’s privacy policy shall apply to any data collected in connection with this Programme and can be found online at www.octopus.energy/privacy

  16. You must obtain Octopus Energy’s prior written consent for all communications (whether oral or written) containing any information relating to Octopus Energy or the Programme, prior to the communication being made.

  17. You must follow the Affiliate Marketing Guidelines supplied by Octopus, including using specified copy.


    Warranties and Liability

  18. By participating in the Programme, you warrant that all information submitted by you is true, current and complete. If any information you share with us is found to be fraudulent or incorrectly completed or if Octopus Energy has reasonable grounds to believe that you have breached any of these Terms and Conditions, Octopus Energy reserves the right to terminate these Terms and Conditions with you.

  19. Octopus Energy’s liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with these Terms and Conditions or the Programme shall be limited to the amount of Commission for referrals which remain unpaid as at the date of the relevant claim.

  20. These Terms and Conditions and the Programme is governed by the laws of England and Wales.
