Terms and Conditions for the Crowdflex trial run by Octopus Energy

These Terms and Conditions apply to Crowdflex trial run by Octopus Energy (the “Trial”). By entering the Trial, you agree to be bound by the following terms and conditions.

Introduction

  1. The Trial will be run by your applicable energy supplier, which will be either Octopus Energy Limited (reg number 09263424), or Octopus Energy Operations Limited (reg number 14415312) each with registered office address at 5th Floor UK House, 165-182 oxford St, London W1D 1NN (collectively referred to here as “Octopus Energy”, “we”, “us”).
  2. The Trial is run by Octopus Energy as part of a wider OFGEM Strategic Innovation Fund (SIF) consortium project, Crowdflex, in collaboration with National Grid Electricity Systems Operator (ESO), Centre for Net Zero (CNZ), Environmental Resources Management (ERM), OHME Operations, Southern Electric Power Distribution, National Grid Electricity Distribution, OVO Energy, Amazon Web Services, Centre for Sustainable Energy (CSE) and Smith Institute (“Partners”) (though to be clear, the Partners are not a party to the Terms and Conditions).
  3. These terms and conditions, together with any specific information or rules set out in any communications relating to the Trial, are the Trial rules (“Rules”). By entering this Trial, you are agreeing to be bound by these Rules and any other applicable instructions provided to you by us.
  4. Octopus Energy reserves the right to cancel or amend the Trial and/or the Rules without prior notice. Any changes will be posted on our website.
  5. In the event of any dispute regarding any aspect of the Trial, the decision of Octopus Energy shall be final and no correspondence will be entered into.
  6. These Trial terms and conditions are separate to the terms governing your supply of gas and electricity that you have with Octopus Energy Limited or Octopus Energy Operations Limited (together being “Octopus Energy Supply”), and will not affect your rights and obligations under those terms.

    Participation
  7. There is no entry fee to join this Trial.
  8. To sign up to this Trial you need to opt-in at the link emailed to you and accept these terms and conditions.
  9. To be eligible for this Trial, you must:
    1. Be 18 or over
    2. Be a resident of Great Britain (excluding Northern Ireland) and a current electricity supply customer of Octopus Energy Supply
    3. Have an eligible, working electricity smart meter and have consented to us collecting half-hourly readings
    4. Comply with these terms and conditions at all times
  10. The Trial period will start at 00:01 on Monday 06th May 2024 and will end at 00:01 on Saturday 3rd August 2024, however we can cancel the Trial at anytime by notice to you. Participation in the Trial will not entitle you to participation in further trials that may be run after this period.
  11. Customers will be able to decide which of the Events they are invited to that they participate in. Prior to each Event, we will attempt to send you a notification of the Event window, the desired demand shift (turn up or turn down) and the available payment per kWh demand shift (the “Incentive”). The Incentive is not fixed and may be different for different customers and for different Events. Events may be locationally specific and different customers may be invited to different Events or to different demand shift actions (turn up or turn down) based on their home location. There is no guarantee as to the number of Events and no upper or lower limit.
  12. To be eligible for payment for an Event, you must have been invited to that Event and you must opt-in to the Event before it begins and
    1. For Events that request turn-down, you must reduce electricity import as measured by your smart meter compared to a “Baseline” during any of the half-hours of the Event window.
    2. For Events that request turn-up, you must increase electricity import as measured by your smart meter compared to a “Baseline” during any of the half-hours of the Event window.
  13. You will be paid the Incentive for each half-hour of the Event that you achieve the requested demand shift action. We will use our reasonable endeavours to credit your account with your Incentive within 14 business days of each Event.
  14. We will calculate your Baseline using the BSC P376 ‘Utilising a Baseline Methodology to set Physical Notifications’ without an in-day adjustment. The Baseline is the average consumption for the same period(s) over up to 10 days of your recent smart meter history, excluding days where an Event has taken place.
  15. If you also have an export meter associated with your import meter signed up to Crowdflex, your Baseline will be calculated using your net consumption (import minus export).
  16. In the event that we’re unable to pull your meter readings to calculate your usage from any of the Events, we’ll work it out using an average across all Event participants.
  17. If you do any of the following, we reserve the right to remove you from the Trial:
    1. You remove your consent for us to take half-hourly meter readings
    2. Your smart meter becomes disconnected for a continuous period of 30 days or more
    3. You cease being an electricity customer of Octopus Energy Supply
    4. You move home and no longer have an eligible meter
    5. You breach either these terms and conditions or your energy supply terms and conditions
  18. Octopus Energy will not be liable to reimburse any expenses incurred with entering the Trial. Octopus Energy does not accept liability for any equipment malfunction that occurs during the Trial.
  19. If at any point you wish to opt-out of the Trial, please email hello@octopusenergy.com and we will remove you within a reasonable period of time of receiving your request. Please allow at least 14 business days from sending your opt-out email for our records to be updated.
  20. If you exit the Trial or are removed from the Trial for any reason you will not be eligible for any further payments from the Trial.
  21. We reserve the right to limit the number of participants on this Trial, and may therefore refuse any applications to participate.
  22. Save to the extent that our liability can not lawfully be limited, our maximum liability to you under this Trail shall be limited to £25.

    Data Protection and Information
  23. Octopus Energy’s privacy policy shall apply to any data collected in connection with the Trial and can be found on our website here.
  24. The Trial is provided by Octopus energy as part of an OFGEM SIF Consortium project, in collaboration with Partner companies. By entering the Trial you agree that, for the purpose of consumer research and for analysing results of the Trial, Octopus Energy may provide information to the Partner companies about your residence (including but not limited to property type, generalised location, presence of low carbon technologies, heating type, EPC rating) information about your household (including but not limited to, generalised level of annual electricity consumption, type of electricity tariff, perceived financial vulnerability, occupancy) and half hourly electricity consumption, baseline and demand flexibility (turn up and turn down) data. The privacy policies of each CSE, CNZ and ESO, which can be obtained from them directly.
  25. By entering the Trial you further agree that, for the purpose of administering the Trial, Octopus Energy may share your Meter Point Administration number with National Grid Electricity System Operator (ESO) and with your Distribution System Operator (DSO) (you can find your DSO here).
  26. The results of the Trial belong to Octopus Energy and to Partners in the Crowdflex consortium. As part of the Trial, we will be required to share anonymised, aggregated data collected during the trial with the Crowdflex consortium to analyse results coming from all of the Partners contributing to the Trial. By entering the Trial you agree to your information being used as such.
  27. Octopus Energy may contact you to invite you to participate in further studies within the trial and/or run by Partners. Any agreement that you choose to enter into with Partners will be governed by their Privacy Policies and is separate from Octopus Energy.
  28. We may also use your energy consumption information for our own research purposes and to help improve our products and services. By entering into the Trial you agree to your information being used in this way.
  29. By entering the Trial, you warrant that all information submitted by you is true, current and complete. If any information you submit is found to be fraudulent or incorrectly completed or if Octopus Energy has reasonable grounds to believe that you have breached any of the Rules, Octopus Energy reserves the right to disqualify you from the Trial.
