Works With Octopus Terms and Conditions

These Terms and Conditions apply to the "Works With Octopus’’ programme (the “Programme”). By joining the Programme, you agree to be bound by the following Terms and Conditions:

1. The Programme is offered by Octopus Energy Limited, a company registered in England and Wales with registered number 09263424 and registered office UK House, 5th Floor, 164-182 Oxford Street, London, United Kingdom, W1D 1NN (“Octopus Energy”).
2. Further details of the Programme are found on our website at https://octopus.energy/works-with-octopus/.
3. To participate in the programme you must submit your application via our webform portal, or otherwise have written communication from Octopus agreeing to your participation in the programme.
4. When you are signed up to the Programme, you agree to provide the services described in your application.
5. This is a non-exclusive programme, and Octopus may appoint any party to provide services to Octopus that are the same as or similar to the services offered by you.
6. During your participation in the Programme, Octopus grants a non-exclusive, revocable, personal, royalty-free licence to use the Octopus trademarks and logos solely to the extent necessary for you to carry out your obligations in relation to these Terms and Conditions.
7. Octopus will not be liable for any costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses) arising out of or in connection with the Programme.
8. Octopus Energy reserves the right to cancel or amend the Programme without prior notice. Any changes will be posted on our website, but we will do our best to avoid doing so. In the event of any dispute regarding any aspect of the Programme, the decision of Octopus Energy shall be final, and no correspondence will be entered into.
9. These Programme Terms and Conditions are separate to the terms and conditions for the supply of gas and electricity that you or other customers referred to Octopus will have with Octopus Energy and nothing under these Terms and Conditions will affect your, or their, rights and obligations under those terms.

Data Protection and Publicity

1. By participating in the Programme, you agree to the reasonable use of your name and image on the Octopus Energy website and in the media and materials produced by or on behalf of Octopus Energy in relation to the Programme. Octopus Energy will retain the rights to any media and materials produced.
2. Octopus Energy’s privacy policy shall apply to any data collected in connection with this Programme and can be found online at www.octopus.energy/privacy
3. You must obtain Octopus Energy’s prior written consent for all communications (whether oral or written) containing any information relating to Octopus Energy or the Programme, prior to the communication being made.

Warranties and Liability

1. By participating in the Programme, you warrant that all information submitted by you is true, current and complete. If any information you share with us is found to be fraudulent or incorrectly completed or if Octopus Energy has reasonable grounds to believe that you have breached any of these Terms and Conditions, Octopus Energy reserves the right to terminate these Terms and Conditions with you.
2. Octopus Energy’s liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with these Terms and Conditions or the Programme shall be limited to the amount of Reward for referrals which remain unpaid as at the date of the relevant claim.
3. These Terms and Conditions and the Programme is governed by the laws of England and Wales.
