POWER HOUR TERMS AND CONDITIONS

General

These Terms and Conditions apply to the Power Hour’ giveaway (the “Giveaway”). By entering the Giveaway, you agree to be bound by the following Terms and Conditions:

The Giveaway will be run by Octopus Energy Limited, a company registered in England and Wales with registered number 09263424 and registered office 33 Holborn, London, EC1N 2HT (“Octopus Energy”).
Octopus Energy Group Limited, with registered number 09718624 (“OEGL”), and other group companies thereof, may also promote this Giveaway.
These terms and conditions are the Giveaway rules (“Rules”) that apply to this Giveaway. By entering this Giveaway, you are agreeing to be bound by these Rules and any other applicable instructions.
Octopus Energy reserves the right to cancel or amend the Giveaway and/or the Rules without prior notice. Any changes will be posted on our website, but we will do our best to avoid doing so.
In the event of any dispute regarding any aspect of the Giveaway, the decision of Octopus Energy shall be final and no correspondence will be entered into.
These Giveaway terms and conditions are separate to the terms and conditions for the supply of gas and electricity that you will have with Octopus Energy and will not affect your rights and obligations under those terms.

Giveaway Entry
Entrants must be 18 or over. Only residents of Great Britain who are customers of Octopus Energy are eligible to take part in the Giveaway.
To enter the Giveaway, you must, between 09:00 on 20 July 2021 and 23:59 on 31 August 2021 (the “Promotional Period”):
a) have a smart meter that Octopus Energy can connect to;

b) expressly opt in to the Giveaway and give us permission to access smart meter readings on a half hourly basis using the link provided by Octopus Energy via email following installation. Failure to opt in will invalidate your entry to the Giveaway.
Only customers who have a smart meter and opted in to the Giveaway during the Promotional Period will be eligible for the promotion, unless otherwise specified in writing.
Any entrant who attempts to take part in the Giveaway in a manner which Octopus Energy deems is contrary to these terms and conditions or the Rules, may be removed from the Giveaway at Octopus Energy’s sole discretion.
A sign up will only count for the purposes of this Giveaway if the entrant is a customer of Octopus Energy at the time of entry into the Giveaway and completes the requisite steps set out in 9(a) and (b) prior to the end of the Promotional Period, which will require the use of the data you have provided to us pursuant to our role as your energy supplier. By accepting these terms, you are agreeing to our use of this data for the purposes of this Giveaway.
Should a sign up be unsuccessful for any reason (for example a fraudulent entrant or if the entrant decides not to complete their smart meter installation with Octopus Energy, leaves Octopus Energy, or subsequently removes their smart meter, or decides at any point to opt out of the Giveaway), this sign up will not be counted and will not be eligible for the Power Hour. The final decision shall be at Octopus Energy’s complete and sole discretion and no correspondence will be entered into over any dispute.
By entering the Giveaway, you warrant that all information submitted by you is true, current and complete. If any information you submit is found to be fraudulent or incorrectly completed or if Octopus Energy has reasonable grounds to believe that you have breached any of the Rules, Octopus Energy reserves the right to disqualify you from the Giveaway.
No liability is accepted for entries that are not received by Octopus Energy for any reason. Octopus Energy retains the right to refuse admission of any illegitimate sign ups. The decision as to whether a sign up is illegitimate shall be at the absolute discretion of Octopus Energy.
Octopus Energy will not be liable to reimburse any expenses incurred with entering the Giveaway.

Power Hour Giveaway
All successful sign ups to the Giveaway shall receive one hour of green electricity free of charge, each month following the month the customer has complied with the obligations in clause 9(a) and 9(b) until 23:59 on 31 December 2022 (the “Power Hour”).
The hour of electricity that will constitute the Power Hour in each case shall be one of the cheapest, greenest daylight hours forecasted by Octopus Energy (at Octopus Energy’s sole discretion), and the successful entrants to the Giveaway shall be informed of the precise timing of the Power Hour by email within 24 hours of each Power Hour.
The Power Hour will be in the form of credit applied automatically within 30 days of the Power Hour to the customer’s Octopus Energy account for any billed amount from the month following the customer’s completion of the obligations in clauses 9(a) and 9(b) until 23:59 on 31 December 2022.
The Power Hour only applies whilst the customer is on an Octopus Energy tariff, and the customer’s first Power Hour will be during one of the cheapest, greenest daylight hours of the following month after which the customer has complied with the obligations in clause 9(a) and 9(b). Should the customer switch away from Octopus Energy at any point during the 12 month period from the customer’s supply start date, credit will only be applied to any billed amount from Octopus Energy during that time. Any unused credit will be forfeited.
The value of the credit applied to the customer’s account will be the value of the energy consumed in the Power Hour as recorded on the entrant’s smart meter. In the event that a meter reading of the Power Hour cannot be taken from any particular customer’s smart meter within 72 hours after a Power Hour event, that customer shall be credited with a sum equal to the value of the average consumption of all Power Hour participants.
By entering this Giveaway, you are agreeing to be contacted by Octopus Energy (using the contact details you have provided us with on your account).
Credits received under this Giveaway are not transferable or exchangeable other than at the sole discretion of Octopus Energy and there is no cash alternative.

Data Protection and Publicity
By entering this Giveaway you agree to the reasonable use of your name on the Octopus Energy website and in the media and materials produced by or on behalf of Octopus Energy or OEGL. Octopus Energy will retain the rights to any media and materials produced.
Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to any third parties without the entrant’s prior consent. Both Octopus Energy’s privacy policy and OEGL’s privacy policy shall apply to any data collected in connection with this Giveaway and can be found online at https://octopus.energy/policies/privacy-policy/. Any data (personal or otherwise) received from an entrant pursuant to the terms of this Agreement shall only be used in accordance with the terms of this Agreement and our obligations to you as your energy supplier, and appropriate security and maintenance systems are in place to ensure the safe-keeping of such data.
Octopus Energy in its sole discretion reserves the right to withdraw or vary the terms of Giveaways and promotions and/or any offer made in connection with them in order to comply with the decision of any relevant judicial or regulatory body and shall not be held liable to any entrant for so doing.
Unless otherwise specified in writing, in the event that you are required to travel to take part in any Giveaway, you are responsible for making all your own arrangements.
The Giveaway is governed by the laws of England and Wales.
