Terms & Conditions

‘OCTOPLUS FESTIVAL TICKETS’ TERMS AND CONDITIONS

General

These Terms and Conditions apply to the ‘Octopus festival’ competition (the “Competition”). By entering the Competition, you agree to be bound by the following Terms and Conditions:

1. Details specific to the Competition are displayed on our website; octopus.energy/Octoplus-Festival-giveaway-tsandcs
2. The Competition will be run by Octopus Energy Limited, a company registered in England and Wales with registered number 09263424 and registered office UK House, 5th Floor, 164-182 Oxford Street, London, United Kingdom, W1D 1NN (“Octopus Energy”).
3. Octopus Energy Group Limited, with registered number 09718624 (“OEGL”), and other group companies thereof, may also promote this Competition.
4. These terms and conditions are the Competition rules (“Rules”) that apply to this Competition. By entering this Competition, you are agreeing to be bound by these Rules and any other applicable instructions.
5. Octopus Energy reserves the right to cancel or amend the Competition and/or the Rules without prior notice. Any changes will be posted on our website, but we will do our best to avoid doing so.
6. In the event of any dispute regarding any aspect of the Competition, the decision of Octopus Energy shall be final and no correspondence will be entered into.
7. These Competition terms and conditions are separate to the terms and conditions for the supply of gas and electricity that you will have with Octopus Energy and will not affect your rights and obligations under those terms.

Prize Draw Entry

8. Entrants must be 18 or over. Only residents of Great Britain who are customers of Octopus Energy are eligible to take part in the Competition.

9. The Competition will run from 00:01, 25/04/2024 up until 23:59, 03/05/2023 (the “Promotional Period”

10. To be entered into the Competition, you must:
a) be a current customer of Octopus Energy; and
b) have a smart meter installed at your property; and
c) be an Octoplus rewards member

11. If the entrant meets the requisite steps set out in 3(a) and 3(b) and 10(c) prior to or during the Promotional Period, they will be automatically opted into the Competition. Entrants can opt out at any time and do not have to accept the prize - if the entrant rejects the prize, Octopus Energy will randomly draw an alternative winner.

12. We will require the use of the data you have provided to us pursuant to our role as your energy supplier. By accepting these terms, you are agreeing to our use of this data for the purposes of this Competition.

13. Where a customer has more than one property, each property will be entered into the Competition so long as the entrant completes the requisite steps set out in 10(a), and 10(b) and 10(c) prior to or during the Promotional Period.

14. Any entrant who attempts to take part in the Competitiony in a manner which Octopus Energy deems is contrary to these terms and conditions or the Rules, may be removed from the Competition at Octopus Energy’s sole discretion.

15. Should a sign up be unsuccessful for any reason (for example a fraudulent entrant, leaves Octopus Energy, or subsequently removes their smart meter, or decides at any point to opt out of the Competition), this sign up will not be counted and will not be eligible for the Competition. The final decision shall be at Octopus Energy’s complete and sole discretion and no correspondence will be entered into over any dispute.

16. By entering the Competition, you warrant that all information submitted by you is true, current and complete. If any information you submit is found to be fraudulent or incorrectly completed or if Octopus Energy has reasonable grounds to believe that you have breached any of the Rules, Octopus Energy reserves the right to disqualify you from the Competition.

17. No liability is accepted for entries that are not received by Octopus Energy for any reason. Octopus Energy retains the right to refuse admission of any illegitimate sign ups. The decision as to whether a sign up is illegitimate shall be at the absolute discretion of Octopus Energy.

18. Octopus Energy will not be liable to reimburse any expenses incurred with entering the Competition.

19. None of the employees, or family members of employees at Octopus Energy or any of its holding companies, subsidiaries or affiliate companies, their agents, or those of their respective group companies may take part in the competition.

Prize

20. All successful entries to the Competition shall immediately enter the draw so long as the customer has complied with the obligations in clause 10(a) and 10(b) and 10(c) prior to and up until 23:59 on 03/05/2023.

21. There will be a total of 13 winners in the Competition.

22. The winners will be announced no later than the 7th May 23:59 and will be notified by a phone call. If Octopus Energy is unable to reach the winner by telephone, an email will be sent with details on how to get in touch with us to claim your prize.

23. Winners will be chosen by an independent judging panel from submissions made online tagging our @OctopusEnergy social channels (on instagram, twitter or tiktok) and from the online form included in our email invitation. Private account votes won't be visible to Octopus and so won't be included.

24. Only 1 entry per household will be entered into the prize draw.

25. The prize will be a pair of festival tickets, we will do our best to accommodate the preferred festival of the entrants but this is not guaranteed. If for some reason the festival does not go ahead, Octopus will add credit of £200 to the customers account in place of the winning tickets.

26. By entering this Competition, you are agreeing to be contacted by Octopus Energy (using the contact details you have provided us with on your account) to inform you if you are a Competition winner.

27. Prizes are not transferable or exchangeable other than at the sole discretion of Octopus Energy.

28. Should the customer switch away from Octopus Energy at any point during the Promotional Period, they will be removed from the Competition.

Tickets

29. All non-photo ticket holders will be required to carry photo ID, to identify themselves as the designated ticket holder.

30. Any tickets that are found to be offered for transfer or sale will be cancelled, and the ticket holders refused admission.

31. All tickets and passes are strictly non-transferable, cannot be sold and the names of all attendees must be provided upon winning the tickets.

32. You will be bound by the individual festival terms and conditions which are available on their websites.

33. We will arrange delivery of both tickets to one address for the winner.

34. Lost or stolen tickets can not be replaced.

Data Protection and Publicity

35. By entering this Competition you agree to the reasonable use of your first name and town on the Octopus Energy website and in the media and materials produced by or on behalf of Octopus Energy or OEGL. Octopus Energy will retain the rights to any media and materials produced.

36. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to any third parties without the entrant’s prior consent. Both Octopus Energy’s privacy policy and OEGL’s privacy policy shall apply to any data collected in connection with this Competition and can be found online at https://octopus.energy/policies/privacy-policy/. Any data (personal or otherwise) received from an entrant pursuant to the terms of this Agreement shall only be used in accordance with the terms of this Agreement and our obligations to you as your energy supplier, and appropriate security and maintenance systems are in place to ensure the safe-keeping of such data.

37. Octopus Energy in its sole discretion reserves the right to withdraw or vary the terms of Competitions and promotions and/or any offer made in connection with them in order to comply with the decision of any relevant judicial or regulatory body and shall not be held liable to any entrant for so doing.

38. Unless otherwise specified in writing, in the event that you are required to travel to take part in any Competition, you are responsible for making all your own arrangements.

39. The Competition is governed by the laws of England and Wales.

40. No purchase is necessary to enter the Competition.

41. Octopus Energy Group employees, contracted employees, or friends and family of employees may not win the prize.
